Completely FREE!!! Flood Victims' Credit Triage
The misery has just begun for people financially living week to week before Hurricanes Helene and Milton. High-interest lenders stop at nothing to collect on their loans. They operate in the grey; their tactics are menacing and barely legal.
My unique skill set will help people rebuild their lives and put themselves first. Credit, Credit Scoring, and Debt Collection are about an oddly specific set of rules. To succeed, you must find out what the rules are and follow them.
Stop, take a deep breath, and realize that the high-interest loans you had before the Hurricanes can be dealt with after your life has stabilized. I can help anyone in this situation find relief using the Fair Debt Collection Practices Act (FDCPA), the main federal law governing debt collection practices. The FDCPA prohibits debt collection companies from using abusive, unfair, or deceptive practices to collect debts from you.
It is called a cease and desist all collection activities letter.
What the process will look like –
- I need their name, phone number, and email address to start the process.
- They will call me, and I will prepare them for the creditor call. I will prepare them for two possible scenarios: either the creditor will be receptive and follow federal law, or the creditor will get aggressive and try to berate, scare, or intimidate them into continuing to make payments. Either way, in the end, they will have to follow Federal Law.
- They will end the initial call with me, call their creditor, verify their identity as usual, and then bring me in on a three-way call. This way safeguards their personal information while they get the help they need from me.
- Once on the call, I will get all the information I need to fax and mail the cease and desist letter to the creditor, as Federal Law requires. While on the call, the creditor takes notes. In those notes, I want the creditor to know that this person understands what their rights are, and they can either settle the debt at some point or file for Chapter 7. That lets them know you aren’t going to be easy to bully.
- Doing this only stops the harassment. We still need to deal with stopping auto drafts and how to avoid garnishment or bank account levies.
- Lay out the steps to get back on track. This might involve settling the debts after they are charged off or filing for bankruptcy. Either way, I will give them a free membership to my credit education platform, The Birds and the Bees of Credit. Everything credit and lending will be discussed thoroughly. Knowledge is power, and the confused are easily misled. You have to choose.
